Terms and Conditions
These Terms and Conditions ("Terms") govern access to and use of Recall Reply ("Recall Reply," "we," "us," or "our"), a software platform that helps dental practices manage missed-call text-back workflows, patient text conversations, and appointment-related communications.
By accessing or using Recall Reply, you agree to these Terms.
1. Eligibility and Authority
You may use Recall Reply only if you are legally able to enter into a binding agreement and, if you are using the platform on behalf of a business or dental practice, you have authority to bind that entity to these Terms.
2. Service Description
Recall Reply provides software and related features for missed-call detection, automated text-back workflows, inbound and outbound messaging, communication history, and related operational tools.
Recall Reply is not a telecommunications carrier, emergency service, medical provider, or appointment guarantee service.
3. Acceptable Use
- Do not send unlawful, deceptive, abusive, or unsolicited messages.
- Do not violate carrier rules, telecom regulations, privacy laws, or healthcare obligations.
- Do not impersonate another person or entity.
- Do not interfere with or disrupt the service.
You are responsible for obtaining any required consent from end users and for honoring opt-out requests.
4. Customer Responsibilities
If you are a dental practice or business customer, you are responsible for the accuracy of your account information, the legality of your messaging activities, configuring workflows appropriately, and complying with applicable healthcare, consumer protection, telecom, and privacy laws.
5. Messaging and Telecom Compliance
Use of Recall Reply may depend on third-party telecom providers and carrier policies, including A2P 10DLC registration, toll-free verification, opt-in requirements, and message filtering rules.
Message delivery is not guaranteed and may be affected by carriers, recipient devices, recipient settings, regulatory requirements, or third-party provider actions.
6. Account Security
You are responsible for safeguarding account credentials and restricting access to authorized personnel only.
7. Data and Privacy
Your use of Recall Reply is also subject to the Recall Reply Privacy Policy. Where we process patient or end-user data on your behalf, you remain responsible for your underlying relationship with those individuals and for your legal obligations regarding their data.
8. No Medical Advice / No Emergency Use
Recall Reply is an operational communication tool only. It does not provide medical advice, diagnosis, treatment, or emergency response.
Do not use Recall Reply for emergencies. If you believe there is an emergency, call 911 or the appropriate emergency services immediately.
9. Availability and Changes
We may modify, suspend, or discontinue part or all of the service at any time, including features, workflows, and integrations. We do not guarantee uninterrupted or error-free operation.
10. Disclaimers
Recall Reply is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied.
11. Limitation of Liability
To the maximum extent permitted by law, Recall Reply and its affiliates, owners, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunities.
12. Termination
We may suspend or terminate access if you violate these Terms, create legal or security risk, fail to pay fees when applicable, or misuse the platform.
